Despite New Bankruptcy Law, Most Are Still Eligible to File
While the new bankruptcy law that went into effect in 2005 added some new eligibility requirements, the vast majority of people with debt problems in New Jersey are still eligible to file bankruptcy.
There are two types of consumer bankruptcy: Chapter 7 and Chapter 13. At the law offices William H. Oliver Jr. & Associates, we offer a free initial consultation to discuss which form of bankruptcy protection is best for you.

Only a Lawyer Can Advise You of Your Bankruptcy Options
Everyone's financial situation is different. Our lawyers will begin your bankruptcy consultation by asking you a few questions:
- What is your income? If you earn more than the median income in New Jersey during the past six months, you may need to file Chapter 13 bankruptcy. However, depending on your expenses, you may be eligible to Chapter 7 bankruptcy even if you're earning above the median income.
- What types of debts do you have? Depending on the type of debt you have, one form of bankruptcy protection may work better for you.
- What assets do you own? If you have assets that you would lose by filing Chapter 7 bankruptcy, you may need to file Chapter 13 bankruptcy instead.
- Have you filed bankruptcy in the past? Your options may be limited if you have filed bankruptcy in the past. However, the rules are complicated. See our attorneys for advice.
