The Bankruptcy Process in Ocean County

Filing for Bankruptcy in New Jersey

When people think about filing for bankruptcy, it is often a fear of the unknown that prevents them from taking advantage of the many benefits bankruptcy has to offer. An experienced New Jersey bankruptcy lawyer can help you through the bankruptcy process in Ocean County and remove a lot of the doubt that could be keeping you from financial freedom.

You are not alone! Millions of people file for bankruptcy every year. We can help you get the relief you need.

At the law offices of William H. Oliver, Jr. & Associates, we provide consumer and business bankruptcy solutions to clients throughout the state. We take the time to explain the entire process to you so you know what to expect as your case moves forward. The following is a brief overview of the typical lifecycle of a bankruptcy at our firm.

  • Building the right solution for you: We know that every situation is unique and that there is no single solution that will work for every person. We build a debt relief solution designed to accommodate the unique requirements of your case. We will also walk you through the preliminary steps that need to be taken prior to filing your petition.
  • Filing your bankruptcy petition: We can help you complete the voluntary petition form and gather the required supporting documents for submission to the court. For a Chapter 13 filing, you would also include your proposed repayment plan.
  • The creditors' meeting: This is a meeting where creditors, if they choose to attend, and the trustee have the opportunity to ask the debtor questions about his or her financial affairs. It sounds much worse than it really is and usually only lasts about five minutes.
  • Discharge of debts: In a Chapter 7 filing, you would move directly to the discharge phase. In Chapter 13, the discharge would happen at the end of your repayment plan. Once you receive a discharge, you have no further responsibility for any of the debts included in your bankruptcy.
